Indemnity and Release

By registering for a contemplative hike and/or walk in and around the Hudson Highlands  the “Hike”) sponsored by Beacon Hebrew Alliance (“BHA”), I am voluntarily participating in the Hike.

 In consideration for being permitted to participate in the Hike, and fully recognizing the dangers and hazards inherent in the Hike, and any related transportation, including personal injury, property damage, sickness or wrongful death, possible exposure to COVID-19, as well as the unknown dangers and hazards which may arise in the course of my participation in the Hike, do hereby voluntarily: Agree, for myself, my heirs and my personal representatives, to defend, hold harmless, indemnify, covenant not to sue, release and forever discharge, to the broadest extent allowed by law, Beacon Hebrew Alliance, its directors, trustees, officers, employees, agents, insurers, successors, assigns (together, the “Released Parties”), from and against any and all liabilities, claims, actions, damages, costs or expenses on account of any damage to real or personal property or any personal injury, sickness (including COVID-19) or death arising out of or relating to my participation in the Hike.  With respect to COVID-19 (but without limiting the foregoing release), I understand and agree that this release includes any claims based on the actions, omissions or negligence of BHA and/or the Released Parties, whether a COVID-19 infection occurs, before, during or after participation in the Hike.

I acknowledge that the Hike involves both known and unknown risks. The known risks include, but are not limited to: physical exertion for which I am not prepared; vehicular traffic; road and trail hazards; weather conditions and other forces of nature; illness or accident caused by stress, fatigue, high altitude, or consumption of food and beverage; accident or illness without access to means of rapid evacuation or availability of medical supplies; transportation accidents or incidents; falling; animals; water related injuries; drowning; equipment failure or improper use; slipping; natural and manmade hazards; uneven and/or slippery surfaces; collisions with objects or people; variations in terrain; plants and trees; rocks; debris; obstacles; fatigue; exhaustion; dehydration; lightning; negligence of others; and possible exposure to COVID-19. I understand that the description of risks above is not complete and that the Hike may be dangerous and include other risks. I voluntarily assume all risks of injury and/or death.

I authorize BHA to call for medical care and/or transport me if in the opinion of its personnel such care is needed.  I will pay all costs associated with medical care and related transport, and release, defend, and indemnify BHA for any costs incurred from such medical care and transport, and any claims regarding medical care and/or transport (including claims regarding failure to provide medical care and/or transport).

I consent to the uncompensated use of my image or voice in any photographs, video, film, and sound recordings by BHA for the purpose of publicizing, marketing, advertising, or documenting the activities or for any other related purpose.

By registering for the Hike, I represent that I am at least 18 years of age, that any other adult I have registered has authorized such registration, and that I am  the parent or legal guardian of any minor participant whom I have registered. In addition, I represent and further agree that I and any others I have registered are bound by all the terms of this Indemnity and Release, and that I and any others I have registered are considered “I” in all the clauses of this Indemnity and Release.  With respect to COVID-19, I further represent that I and any others I have registered (together, “We” “Us” or “Our”) will not participate in the Hike under any of the following circumstances:

  1. If any of Us or anyone in Our household has been diagnosed with COVID-19 within the past 14 days
  2. If any of Us has, or within the past 14 days has had, any COVID-19 symptoms such as fever, coughing, shortness of breath, sore throat, or new loss of the sense of taste or smell
  3. If any of Us has knowingly been exposed within the past 14 days to someone with COVID-19 
  4. If any of Us has traveled in the past 14 days to states or countries for which there are NYS or federal COVID-19 travel advisories.

 

I have read this release, I understand it fully, I understand that it is legally binding, and I understand that, among other things, I am agreeing to indemnify BHA for injuries, damages or losses I may cause and giving up rights to sue BHA for injuries, damages or losses I may incur.  

This Indemnity and Release is enforceable to the maximum extent permitted by law.  If any provision is determined to be unenforceable, the remaining provisions shall remain binding.  This Indemnity and Release is governed by New York law.
